1. Acceptance of Terms

By downloading, installing, or using SOND ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

SOND is a voice recording application for iOS that provides:

• Audio recording and storage capabilities
• AI-powered transcription services (optional)
• AI-powered summarization and analysis (optional)
• Cloud backup to third-party services (Yandex.Disk, Google Drive, iCloud Drive)
• Export and sharing functionality

Important: AI processing features are optional and require explicit user action.

3. User Obligations

You Agree To:

1. Legal Use: Use the App only for lawful purposes and in compliance with all applicable laws
2. Recording Consent: Obtain consent from all parties before recording conversations (as required by law in your jurisdiction)
3. Content Responsibility: Be solely responsible for all recordings and content you create
4. No Harmful Content: Not record, store, or process:
   • Illegal content
   • Content that violates third-party rights (copyright, trademark, privacy)
   • Malicious, harmful, or offensive content
   • Child sexual abuse material (CSAM)
5. Account Security: Keep your device secure and prevent unauthorized access

You Agree NOT To:

• ❌ Reverse engineer, decompile, or disassemble the App
• ❌ Use the App to violate any laws or regulations
• ❌ Record conversations without required consent
• ❌ Attempt to gain unauthorized access to our services
• ❌ Interfere with or disrupt the App's functionality
• ❌ Use the App to create, distribute, or store illegal content

4. Recording Consent Laws

IMPORTANT LEGAL NOTICE: Recording consent laws vary by jurisdiction.

One-Party Consent Jurisdictions:

In some regions (e.g., most US states), only one party to the conversation needs to consent to recording.

Two-Party Consent Jurisdictions:

In other regions (e.g., California, some EU countries), ALL parties must consent to recording.

Your Responsibility:

• ✅ Research and comply with local recording consent laws
• ✅ Obtain necessary consent before recording
• ✅ Inform participants when recording
• ❌ The developer is NOT responsible for your compliance with local laws

5. AI Processing Terms

Third-Party AI Services:

When you request AI processing, your data is sent to third-party services:

• AssemblyAI - Audio transcription
• Google Gemini - Content analysis and summarization

You Acknowledge That:

1. AI processing is optional - you must explicitly request it
2. Audio files are temporarily uploaded to third-party services
3. AI-generated content may contain errors or inaccuracies
4. We are not responsible for AI service availability or quality
5. Third-party AI services have their own Terms of Service and Privacy Policies
6. AI processing requires internet connection

AI Content Disclaimer:

• ❌ AI transcripts may contain errors
• ❌ AI summaries are interpretations, not legal documents
• ❌ Do not rely solely on AI output for critical decisions
• ❌ AI may misinterpret context, tone, or meaning

6. Cloud Backup Terms

Supported Cloud Services:

• Yandex.Disk - Requires Yandex account and OAuth authorization
• Google Drive - Requires Google account and Google Sign-In authorization
• iCloud Drive - Uses your Apple ID (no separate authorization)

You Acknowledge That:

1. Cloud backup is optional - you must explicitly enable it
2. Third-party cloud services have their own Terms of Service
3. We are not responsible for cloud service availability, storage limits, or data loss
4. You are responsible for managing your cloud storage space
5. Cloud services may charge fees for additional storage (beyond free tier)
6. Authorization tokens are stored securely in iOS Keychain

Backup Data Structure:

Backups include:

• Audio recordings (.m4a files)
• Transcripts (.txt files)
• Summaries (.txt files)

Files are organized by date and recording title in /SOND_Backups/ folder.

7. Subscriptions and Payments

Payment Processing:

Subscriptions and in-app purchases are processed through:

• Apple App Store - All payments handled by Apple
• RevenueCat - Subscription management service

Subscription Plans:

• Monthly Subscription - Recurring monthly billing
• Annual Subscription - Recurring annual billing (discount compared to monthly)
• Credit Packs - One-time purchases (small, medium, large, extra large)

Subscription Terms:

1. Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
2. Cancellation: Cancel anytime via App Store → Subscriptions (no partial refunds for unused time)
3. Price Changes: We may change prices with 30 days notice
4. Refunds: Handled by Apple according to their refund policy
5. Access: Premium features available only while subscription is active

Credits System:

• 1 credit = 1 minute of AI processing
• Credits never expire
• Credits are consumed when you request AI processing
• No refunds for unused credits

8. Intellectual Property

Your Content:

• ✅ You retain all rights to your recordings and content
• ✅ You own all audio files, transcripts, and summaries created by you
• ✅ We do not claim ownership of your content

App Ownership:

• The App, its design, code, and features are owned by Polina Evdokimova
• Protected by copyright, trademark, and other intellectual property laws
• You receive a limited, non-exclusive, non-transferable license to use the App

Prohibited Actions:

• ❌ Copy, modify, or create derivative works of the App
• ❌ Sell, rent, lease, or sublicense the App
• ❌ Remove or alter any copyright notices or branding
• ❌ Use the App's name or branding without permission

9. Data Ownership and Processing

Your Data:

• Local Storage: All recordings stored on your device belong to you
• Cloud Backups: Files uploaded to your cloud storage belong to you
• AI Processing: Transcripts and summaries generated from your audio belong to you

Google Drive OAuth Scope:

When you authorize Google Drive backup, SOND requests the following limited scope:

• Scope: https://www.googleapis.com/auth/drive.file
• Purpose: Upload and manage only files created by SOND (not access to your entire Drive)
• Permissions: Read, write, and delete only SOND backup files
• No Access To: Your other Google Drive files, emails, contacts, or Google account data

Data Processing Agreement:

By using AI processing features, you grant us a limited license to:

1. Upload your audio to third-party AI services for processing
2. Receive transcripts and summaries from AI services
3. Store processed data locally on your device

We DO NOT: Store your recordings on our servers, use your content for training AI models, or share your content with third parties (except AI processing services you explicitly request).

10. Disclaimers and Limitations of Liability

No Warranty:

SOND is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• ❌ Accuracy of AI transcripts or summaries
• ❌ Uninterrupted or error-free operation
• ❌ Compatibility with future iOS versions
• ❌ Data backup reliability
• ❌ Third-party service availability

Limitation of Liability:

To the maximum extent permitted by law, we are NOT liable for:

1. Data Loss: Loss of recordings, transcripts, or summaries due to device failure, iOS updates, or user error
2. AI Errors: Inaccurate, incomplete, or misleading AI-generated content
3. Third-Party Services: Outages, errors, or changes to AssemblyAI, Google Gemini, cloud storage services
4. Legal Violations: Your violation of recording consent laws or other regulations
5. Indirect Damages: Lost profits, data, or business opportunities
6. Maximum Liability: Our total liability shall not exceed the amount you paid for the App in the last 12 months

11. Service Availability

We Reserve the Right To:

• Modify or discontinue features at any time
• Suspend service for maintenance or updates
• Terminate access for Terms violations
• Change pricing with 30 days notice

No Guarantee:

We do not guarantee:

• ❌ 100% uptime for AI processing services
• ❌ Permanent availability of third-party integrations
• ❌ Future compatibility with all iOS versions
• ❌ Continued support for specific features

12. Termination

You May Terminate:

• Delete the App from your device at any time
• Cancel subscriptions via App Store settings
• Request data deletion (see Privacy Policy)

We May Terminate:

• Suspend or terminate access for Terms violations
• Discontinue the App with 30 days notice
• Revoke credits in case of abuse

Effect of Termination:

• Your license to use the App ends immediately
• Local data remains on your device (you can export before uninstalling)
• Unused subscription time is non-refundable
• Credits are forfeited upon termination

13. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for details on:

• What data we collect
• How we use and protect your data
• Third-party data sharing
• Your privacy rights (GDPR, CCPA)
• Data retention and deletion

By using SOND, you also agree to our Privacy Policy.

14. Age Restrictions

• Minimum Age: You must be at least 13 years old to use SOND
• Parental Consent: Users under 18 should obtain parental consent
• Age Rating: 4+ on App Store (suitable for all ages but requires reading comprehension)

If you are under 13, do not use the App or provide any personal information.

15. International Use

SOND is available worldwide, but you are responsible for compliance with local laws, including:

• Recording consent laws
• Data protection regulations (GDPR, CCPA, etc.)
• Export control laws
• Telecommunications regulations

Note: Some features (AI processing) may not be available in all regions due to third-party service restrictions.

16. Third-Party Links and Services

The App may contain links to or integrate with third-party services:

• AssemblyAI (transcription)
• Google Gemini (analysis)
• Yandex.Disk (backup)
• Google Drive (backup)
• iCloud Drive (backup)
• Firebase (analytics)
• RevenueCat (payments)

17. Updates and Modifications

App Updates:

• We may release updates to fix bugs, improve performance, or add features
• Updates may be required for continued use
• You are responsible for keeping the App updated

Terms Updates:

• We may update these Terms at any time
• Material changes will be communicated via in-app notification
• "Last Updated" date will reflect changes
• Continued use after changes constitutes acceptance

18. Governing Law and Dispute Resolution

Governing Law:

These Terms are governed by the laws of the Republic of Serbia, without regard to conflict of law principles.

Dispute Resolution:

1. Informal Resolution: Contact us at polya.dsgn@gmail.com to resolve disputes informally
2. Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration
3. Class Action Waiver: You agree to resolve disputes individually, not as part of a class action

EU/EEA Users:

If you are in the EU/EEA, you have the right to bring claims in your local courts and are not bound by the arbitration clause above.

19. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
